A potentially important witness has invoked the Fifth Amendment — and now the court must determine what happens next.
On Day 3 of Yella Beezy’s capital murder trial, Theodore “Jose Bodega” Thomas appeared with his attorney and invoked his Fifth Amendment privilege during a hearing outside the jury’s presence.
Bodega previously provided grand-jury testimony and is at the center of disputed statements involving the prosecution’s allegations. The defense has challenged the reliability of portions of his earlier account.
The judge ordered Bodega to return Friday with counsel. Whether he will testify substantively, and whether any earlier statements may be used, remain unresolved.
