Lindsay Clancy’s defense has filed a motion targeting the one juror who wouldn’t vote to acquit.
Attorney Kevin Reddington is asking Plymouth Superior Court for the holdout juror’s jury questionnaire, records of a 2021 prosecution and abuse-prevention order, and cellphone data from all 38 hours of deliberations. He’s also asking for sworn questioning of the juror about his jury selection answers and any outside information — and testimony from another juror about his phone activity.
At the same time, the defense is pushing to block a retrial on double jeopardy grounds.
A hearing is set for September 29.
