Lindsay Clancy returned to court today for her first hearing since the September 4 mistrial, and once again, nothing was decided. Judge William Sullivan took the defense’s motion for a not-guilty finding under advisement and pushed the double jeopardy motion, the holdout juror motion, and the prosecution’s gag order request to a new hearing on November 2.
Meanwhile, the fight outside the courtroom is getting ugly. Clancy’s attorney Kevin Reddington has called holdout juror Michael Desronvil an “obstructionist juror” and filed a motion seeking his phone records. Now he says all he did was file a motion and he’s not the bad guy. Desronvil’s attorney, Edward Paltzik, isn’t buying it. He says his client went into hiding after death threats and plans to file a bar complaint against Reddington, accusing him of attacking the Sixth Amendment.
The jury reportedly split 11–1 in favor of finding Clancy not criminally responsible because of postpartum psychosis. Desronvil says he had no doubts. Other jurors say he admitted reasonable doubt but refused the insanity verdict. And Plymouth County DA Timothy Cruz still won’t say whether he’ll retry the case.
